Terms of Use

These Terms of Use (“Terms”) govern your use of the independent Duty, Honor, Country song archive (the “Site”). By using the Site, you agree to these Terms. If you do not agree, do not use the Site.

Independent archive

The Site is an independent historical and cultural project. It is not an official website of the United States Military Academy, the Department of the Army, the Department of Defense, or any linked organization. Institutional names and references are used for historical and descriptive purposes.

Music, recordings, photographs, and archival material

Copyright, trademark, publicity, privacy, and other rights in the song, arrangements, recordings, photographs, publications, and archival materials remain with their respective owners. Except for the specific free PDF described below, access to the Site does not grant permission to copy, adapt, arrange, redistribute, record, synchronize, publicly perform, publish, sell, or commercially use protected material.

Free melody-and-words PDF

Howard D. “Doug” McInvale has authorized the specifically labeled one-page melody-and-words lead sheet, including its printed chord symbols, as a free PDF download. You may download and print that file without charge. Do not alter it, resell it, remove attribution or notices, or represent it as your own work. The free download does not grant rights in any fuller arrangement, recording, photograph, or other Site content, and any use beyond the authorization stated with the file may require separate permission from the appropriate rights holder.

Protected arrangements and individualized requests

Orchestra, SATB mixed choir, TTBB men’s choir, piano/vocal, and other fuller arrangements remain protected. Requests are considered individually and may be approved, declined, limited, referred to a rights holder, or answered with a custom quote. Submitting a request does not create a contract, guarantee availability, set a price, or grant a license. Any permission, license, delivery, or price must be confirmed separately in writing.

Comments and other submissions

Submit only material you are entitled to share. By submitting a comment for possible publication, you give the Site a nonexclusive, worldwide, royalty-free license to review, reproduce, format, display, and preserve that submission in connection with the song and its archive. You retain any rights you otherwise hold. Comments are moderated and may be edited for formatting, declined, unpublished, or removed at any time.

Acceptable use

You may not use the Site to violate law or another person’s rights; submit unlawful, threatening, harassing, discriminatory, defamatory, deceptive, invasive, infringing, or promotional material; impersonate another person; disclose private information without authority; transmit malicious code; evade security or rate limits; scrape or submit forms through abusive automation; interfere with the Site; or misrepresent an affiliation with the Site, the song’s creators, West Point, the Army, or the Department of Defense.

Links and embedded media are provided for context and convenience. The Site does not control and does not endorse every statement, product, practice, security measure, or policy of a third-party service. Your use of a third-party service is governed by that service’s terms.

The Site is provided for historical, educational, and cultural purposes on an “as is” and “as available” basis. Although reasonable care is taken, no promise is made that content will always be complete, current, accurate, uninterrupted, secure, or error-free.

Limitation of liability

To the fullest extent permitted by law, the Site’s maintainers, contributors, and rights holders will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of, or inability to use, the Site or linked services. Changes, suspension, and governing law

The Site, its features, and these Terms may be changed, suspended, or discontinued at any time. The date at the top identifies the current Terms. These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law rules. If one provision is unenforceable, the remaining provisions continue in effect.
